In this section we specify the General Terms and Conditions of Car Hire applicable to the reservations at ROIG Rent a Car. Extraordinarily, offers and promotions or web rates may be applied that involve some change or modification in the conditions of the rates and general reservations, so it will be important to review in detail the conditions attached to the offers and promotions that the Customer may want to benefit from, accepting them with the signature of these.

The Client receives the vehicle described in the Rental Contract, in perfect working condition, with all its documents, tyres, tools and accessories and undertakes to maintain them and drive the vehicle in accordance with the rules of the Highway Code as well as of those set out in these General Terms and Conditions of Car Hire. Before collecting the vehicle, the Customer is authorised to have the condition of the vehicle checked in his presence.

2.1 Age requirements
  • The minimum age of the driver must be 21 years and having held a driving licence for at least one year (see section 2.2). On the other hand, the maximum age of the driver cannot exceed 84 years.
2.2 Driving licence

The Customer must be in possession of the appropriate valid driving licence approved in the country of supply of the ROIG vehicle, the Customer being directly responsible for the validity and approval of the driving licence, and must hold ROIG harmless against all claims, and must have held the licence for at least one year. At the same time, the minimum age of the Customer must be 21 years. Likewise, and in all cases, the Customer must have held the driving licence for at least one year, regardless of the Customer’s age.

3.1 Payment obligations

The Customer undertakes to pay to ROIG 

  1. a) The charges for vehicle rental, insurance and taxes set out in ROIG’s current rate which has been  previously notified to the Customer as a result of having been contracted by him. The application of  the initially agreed rate is subject to the vehicle being returned at the agreed place, date, time and  under the agreed conditions. The rates may vary depending on the season and the offices, so before hiring a vehicle, the Client will be responsible for verifying the rate that will be applied. 
  2. b) Any other services applicable to the Customer, in accordance with the contractual and commercial  conditions offered by ROIG. 
3.2 Payment Methods admitted at destination
  • VISA or MasterCard credit card (except prepaid cards). 
  • Debit card or cash, provided that the ¨Keep Calm Package¨ has been contracted (3€ or 8€ per day  depending on the car model) and the fuel tank is paid for in advance. This condition does not apply  to models classified as ROIG Premium, where only credit card payment is permitted.
3.3 Payment restrictions and requirements
  • The holder of the bank card used to pay for the rental must be registered on the Rental Contract,  either as the contract holder or as a second driver. 
  • The payer must ensure that his bank card has sufficient funds available at the time of collection of  the vehicle in order to be able to proceed with the payment of the rental with all the contracted options. In addition, if the all-inclusive insurance has not been taken out, the corresponding excess  will be blocked on the same card. 
  • Only one bank card can be used per Rental Contract and it must be non-transferable. The payer is responsible for knowing the PIN of his bank card if he pays with a card that includes this technology. 
  • Regardless of the method of payment selected, a credit card must be provided as a guarantee or, in  its absence, the ¨Keep Calm Package¨ must be taken out and the fuel tank must be paid in advance.
  • It should also be considered that, regardless of the method of payment, if an all-inclusive insurance  has not been taken out, the corresponding excess will be blocked on the same card. 

The cardholder must ensure that the use of the card in order to satisfy these General Rental Terms and  Conditions of Car Hire (deposit, withdrawals, etc.) will not cause him any prejudice. 

On this matter, the cardholder undertakes to obtain all the necessary information from his bank prior to the  use of his card by ROIG, that will not be held responsible on this matter. 

Payment for the vehicle rental and any additional costs will be made in the currency chosen by the  Customer. However, the holder of the credit card provided must be registered on the Rental Contract either  as the contract holder or as a second driver.

5.1 Our applicable rate includes
  • VAT, taxes and local taxes. 
  • The compulsory insurance or basic insurance of the vehicle covers, against payment of an excess,  the damages caused to the vehicle and the damages caused to the occupants of the vehicle. The  amount of the excess will be temporarily blocked on the credit card or temporarily debited from the  debit card and varies according to the category of the rented vehicle, i.e:  

If the Customer takes out the complementary “All Inclusive” cover, the amount of the above excess  will not be temporarily blocked or charged on the payment card. 

The purchase of the complementary “All Inclusive” cover may be done, at the Customer’s choice, at  the time of the online booking or at the time of the pick-up of the vehicle. 

The maximum amount of the supplementary costs to be invoiced to the Client for damages occurred  during proper use of the vehicle will not exceed the amount of the excess applicable to each  category of vehicle. Clients who have taken out the all-inclusive insurance are not obliged to deposit  the excess and will not be held liable in the event of an incident except in the event of unauthorised  use of the vehicle as specified in article 12 of the General Terms and Conditions of Car Hire. Clients  who do not want to take out this complementary cover will have to deposit a guarantee for the  amount equivalent to the value of the excess, which amount is specified in this article.

5.2 Additional services included
  • Night service: For vehicle pick-ups and drop-offs at night, i.e. between 23:00h and 07:00h, only the  ‘Smart Lock’ rental rate will be available. ROIG may request the flight number of arrival prior to the  formalisation of the Rental Contract. 
  • Basic roadside assistance: this service provides roadside assistance in the event of breakdown and  includes the cost of labour of any repairs that can be carried out in situ at the place of the breakdown during office opening hours (8:00h to 20:00h). In no case does this service include towing and/or taxi expenses.
5.3 Our prices do not include

The rental rate does not include the following services, which from now on will be considered as Extras: 

  • Additional drivers: The rental rates include in the price the cost of hiring a second driver. The  additional cost of adding another driver is 8€ per day and driver, up to a maximum of 80€ per rental  and driver. A maximum of 3 additional drivers may be included in a Rental Contract. 
  • Child seats: The cost of hiring a child seat is 8€ per day per seat, up to a maximum of 80€ per seat. 
  • In the event that the Customer has contracted the Relax or Basic rate and his flight is delayed,  arriving after 22:00h, a night supplement of 44€ will be charged. 
  • The Customer may contract the ´Keep Calm Package’, for 3€ or 8€ per day depending on the model, which will exempt the Customer from the payment of the following fees: 

– Costs of fine management 

– Costs of lost or broken keys 

– Costs of refuelling with inadequate fuel 

  • Extended roadside assistance service: The Customer may contract our extended roadside  assistance service which includes 24-hour assistance service, roadside assistance in the event of a  puncture, towing and/or taxi service costs and the replacement of the vehicle in the event of a  breakdown, which will be carried out at the nearest ROIG office. The cost of contracting this service  is 5€ per day.

Delivery and collection at the airport: the supplement for collection and/or return at Palma de  Mallorca Airport car park is 25€ per service (50€ per collection and return service) with the Relax  rate and 20€ per collection and return with the Smart Lock rate. The costs of the car park ticket at  the time of the pick-up of the vehicle will be paid by the Customer within a maximum amount of  approximately 20€.

6.1 Duration of the Rental Contract

The duration of the Rental Contract is the one stated in the Rental Contract, where the date and time of  delivery and return of the vehicle are specified. 

The rental days are calculated in periods of 24 hours counting from the exact time at which the Customer  has rented the vehicle until the vehicle, its keys and documentation have been received back by ROIG. The  grace period for the car return will be 59 minutes. 

The maximum duration of the Rental Contract is 90 days. 

If the Customer decides to terminate the Rental Contract early, without 24h previous notice, the amount  corresponding to one day’s rental (including taxes) will be retained. The remaining amount of the rental days  will be refunded through the same payment method used. 

Furthermore, in the event that ROIG decides to terminate the rental prior to the date specified in the Rental  Contract, the Customer will be entitled to receive from ROIG a full refund of the amounts paid corresponding  to the lost days of use of the vehicle (including taxes), with no further claims.

6.2 Extension of the Rental Contract

The Customer is obliged to return the vehicle at the date and time specified in the previous paragraph.  

The extension of the Rental Contract does not imply the right to continue with the initial rate that has already  expired. In the case of an extension of the Rental Contract, the extended days or extras services to be added will be calculated on the current general rate. 

Under no circumstances may the amount deposited as a guarantee be used to extend the Rental Contract.  Therefore, in the event that the Rental Contract is extended, the Customer will have to make an additional  payment for such extension. 

If the Rental Contract cannot be extended due to unavailability of vehicles or for any other reason, the  Customer must return the vehicle at the agreed date, office and time. 

6.3 Modifications and cancellations

Cancellation policy for prepaid bookings made through the ROIG website: 

  • Reservations paid in advance through the ROIG website may be cancelled free of charge up to 24  hours before the start of the rental. The refund of the total amount paid in advance by the Client will  be made onto the credit or debit card used to make the payment. ROIG’s reservation processing  system assumes that the 24-hour advance notice period expires exactly one minute after reaching  24 hours previous to the pick-up of the vehicle. In the event of cancellation of the reservation after 24 hours prior to the start of the rental, ROIG will retain the amount corresponding to one day of rental  as a freely agreed compensation. 
  • In the case of an extension of the Rental Contract, the extended days or extra services to be added  will be calculated on the current general rate (see point 6.2 of the General Terms and Conditions of  Car Hire).
  • If the Customer decides to terminate the Rental Contract early, without 24h previous notice, the  amount corresponding to one day’s rental (including taxes) will be retained in accordance with the  regulations in point 6.1 of the General Terms and Conditions of Car Hire. The remaining amount of  the rental days will be refunded through the same payment method used. 
  • To obtain a refund of the prepaid amount, the Customer should send an email to info@roig.com or  call +34 971 65 71 73. 

In the event that a promotion, special rate or offer implies that no refund will be made in the event of  modification or cancellation of the reservation, the amount previously paid (including taxes, fees or  other charges) will be retained by ROIG as a compensation freely agreed by the parties, even if the  Customer does not make use of the reserved vehicle.

7.1 On the collection of the vehicle at the office
  • The booking voucher must be presented at the time of collection of the vehicle. 
  • Passport or ID card, driving licence and a valid credit or debit card must be presented at the time of  collection of the vehicle. 
  • If you rent a GPS device, a deposit of 50€ must be paid as a guarantee, which will be blocked on  your credit card. 
  • The car hire is not necessarily linked to a specific vehicle (make/model, colour, equipment, etc.) but  to a group of vehicles with similar technical and habitability characteristics. In the event that a model  from the selected group is not available, one of a higher category will be provided. 
  • ROIG reserves the right to cancel the vehicle supply in the event of justified doubts as to the  Customer’s financial capacity or in the event of a history of non-payment or serious incidents with  ROIG. 
  • Regardless of the method of payment chosen, a credit card must be presented as a guarantee or, in  its absence, the ´Keep Calm Package’ must be contracted (3€ or 8€ extra per day depending on the  model of the car) together with a prepayment of the fuel tank. 
  • It should be taken into account that, regardless of the method of payment, if the all- inclusive  insurance has not been taken out, the corresponding excess will be blocked on the same card.
7.2 Autonomous vehicle collection (via mobile phone)

If the ‘Smart Lock’ collection service has been contracted, the vehicle will be collected completely  autonomously by the Customer at the agreed collection point and without need for assistance in person by  any ROIG employee. 

The Customer may consult the assigned vehicle and its registration number prior to the start of the rental  reservation. The Customer will be notified via the messaging platform selected by ROIG, this could be via  SMS or email. 

24 hours before the start of the rental, the Customer will receive a link to find and carry out the opening of the vehicle. The first opening of the vehicle will be done through the link provided by the messaging service  established by ROIG (SMS or any other similar service that may replace them in the future). Between 1 hour  and 30 minutes before the start of the reservation, the Customer will be able to see the exact location of the  vehicle. It is vitally important that the Customer has an internet connection, as this will be necessary in order  to initiate the opening process of the vehicle.

The keys and, where applicable, any tickets or cards that may be required during the rental period will be  provided in the glove compartment of the vehicle. In the event of a possible failure of the autonomous  opening system, ROIG undertakes to deliver the vehicle and the keys to the Customer in person, at the  agreed delivery point, in the shortest possible time. 

7.3 Airport pick-up

The Client will have an option to contract the supplement for the airport car park pick-up service with the  Smart Lock Rate (20€ for pick-up and return) and with the Relax Rate (25€ per service. 50€ for pick-up and  return). 

Please note that for rentals with delivery at Palma de Mallorca airport car park, in addition to the cost of the  delivery supplement, the Customer will have to pay for the airport car park exit ticket, which will have a  maximum cost of approximately 20€.

Compulsory civil liability insurance

8.1 Compulsory insurance and civil liability insurance against third parties

The rental rates include compulsory car insurance cover and supplementary civil liability insurance cover for  damages to third parties resulting from the use and circulation of the vehicle. 

This cover is guaranteed and assumed by the insurer with which ROIG has contracted the corresponding  insurance policy and is subject to the general and specific clauses of the policy and to the law. By signing the Rental Contract, the Customer agrees to be insured under the aforementioned policy, the terms and  conditions of which are available to the Customer. 

8.2 Basic insurance with excess (SBcF)

The rental rates also include basic insurance, which covers damages caused to the vehicle as a  consequence of: 

  1. a) collision, 
  2. b) theft, 
  3. c) and accidental fire or vandalism. 

The basic insurance includes an excess for such damages for which the Customer is directly liable (see point 4 of the General Terms and Conditions of Car Hire). This excess must be guaranteed (i) by the provision of  the corresponding deposit or (ii) by taking out an additional insurance. 

The basic insurance will be valid provided that the following conditions are met: 

  1. a) That the Customer, in the event of a collision, provides ROIG within forty-eight hours after the  accident with full details of the other party and possible witnesses by filling in an accident report by  means of a ‘Amicable Accident Report’ – in Spanish ´DAA´- detailing the car registration number, the name and address of the other party, the circumstances of the collision, a sketch of the accident, the  name of the insurer and, where possible, the insurance policy number, all signed by the two drivers 

involved in the accident, or, if this is not available, the ‘Damage Report’, which will be provided by  ROIG. 

  1. b) That the insurance company does not reject the claim as a consequence of the Customer not driving the vehicle in the physical and mental conditions required by the Highway Code. 
  2. c) That the collision, theft, fire or act of vandalism has not occurred during the course of unauthorised  use, such as those included in the point 12 of these General Terms and Conditions of Car Hire. 
  3. d) That the Customer has notified ROIG of the collision, theft, fire or act of vandalism that has occurred  to the vehicle within forty-eight hours of its occurrence, providing the relevant documentation  (accident report, report to the authorities, etc.). 

The following are EXPLICITLY EXCLUDED FROM THE ABOVE COVERAGE: 

  1. a) Damages to tyres, rims, vehicle interiors, exterior rear-view mirrors, windows and the underside of the  vehicle.  
  2. b) Punctures and tyre blowouts. 
  3. c) Damages caused to the clutch and gearbox.  
  4. d) The days during which the vehicle is immobilised until it is repaired.  
  5. e) Towing costs. 

f) Battery recharge.

8.3 Full coverage or all-inclusive insurance

The rental rates do not include all-inclusive insurance, which covers damages not included in the basic  insurance. This insurance can be taken out at the time of collection of the vehicle or through our website and  will only be valid if the Client complies with the conditions set out above in the event of damage to the  vehicle. 

Our all-inclusive insurance consists of the following covers: Basic insurance without excess (SBSF) and  Wheel and glass insurance (SRC). 

8.4 Cancellation of insurance cover

Any cover in the event of a damage will be cancelled if, at the time of the accident, the driver of the vehicle is not listed on the Rental Contract as the main driver or additional driver. 

8.5 Security deposit

Unless the Customer takes out the optional supplementary cover (all-inclusive insurance), a security deposit  must be paid by credit or debit card at the time of pick-up of the vehicle, the amount of which may vary  depending on the model of car chosen. 

In case of extension of the Rental Contract, the initial amount of the security deposit will be increased  according to the number of additional days. 

The security deposit blocked (credit card) or charged (debit card) will be released or refunded to the Client  after the car´s return, and once ROIG has checked that the vehicle is in good condition and that the Rental  Contract has been properly accomplished. If the security deposit is made using a credit card, the maximum  blocking period is 30 working days counting from the beginning of the rental. 

The security deposit will be partially or totally retained in the event of breach of the Rental Contract, until the  penalties or amounts chargeable to the Client are covered, unless the Client has taken out optional  complementary cover. 

The Customer will return the rented vehicle in the same condition in which it was provided, together with all  its documents, tyres, tools, chargers (in the case of an electric or hybrid vehicle) and accessories, at the  place, date and time stipulated in the Rental Contract. At the time of return, the Customer may request that  the condition of the vehicle is checked in his presence. This in-person inspection is subject to the opening  hours of the local office. 

The Customer may not modify any of the vehicle’s technical features, keys, equipment, tools and/or  accessories, nor may he modify any exterior and/or interior appearance of the vehicle. Otherwise, the  Customer will be responsible for the necessary expenses to bring the vehicle back to its original state,  without prejudice to any damages caused to ROIG deriving from the reconditioning of the vehicle during the  time the vehicle has to be immobilised, as well as any other damages caused to ROIG. 

In addition, when the vehicle is returned, an examination of its condition will be carried out, according to  which it will be classified into the corresponding cleaning level. There are 4 different cleaning levels  depending on the degree of dirtiness: general (1), special (2), severe (3) and very severe (4). In the event  that the vehicle is returned and is classified into special (2), severe (3) or very severe (4) cleaning level,  ROIG may charge an amount of up to 250€ to cover the costs of the treatment, cleaning and immobilization  of the vehicle. The different cleaning levels and their cost can be found in Appendix I of the General Terms  and Conditions of Car Hire. 

9.1 Consequences of non-return of the vehicle

If the vehicle is returned at a date and time different to those established in the Rental Contract, ROIG will be entitled to charge a rental amount corresponding to the additional days due to the delay in returning the  vehicle, in addition to a penalty for the financial loss caused, amounting to 30€ per day of delay. 

The return or abandonment of the vehicle in a place different to that indicated in the Rental Contract will  entitle ROIG to demand: 

  1. a rental amount for the additional days necessary to recover the vehicle and make it available for rental; 
  2. in addition, the Customer will be imposed to indemnify ROIG with 30€ per day for the financial loss  caused, 

III. and will also have to pay for the costs of transportation/towing, tolls and storage/custody, where  applicable, to the place of the car return agreed in the Rental Contract. 

ROIG reserves the right to take any legal action that may be appropriate towards relevant authorities in the  event of the disappearance or non-return of the vehicle, and the Customer will be held fully responsible for  any legal consequences that may arise. 

The unilateral extension of the Rental Contract period made by the Customer will also be considered as an  unauthorised use of the vehicle in terms of the Customer’s liability for any damage to the vehicle. 

9.2 Autonomous vehicle drop-off (via mobile phone)

The vehicle will be returned to the drop-off place agreed by both parties. In the event that the vehicle is  returned to the airport car park, ROIG will request from the Customer the exact details of where the vehicle is parked: floor and parking space number. 

For the autonomous return of the vehicle, it will be necessary for the Customer to have an internet  connection to be able to carry out the entire return process. This will require the vehicle key to be placed in  the glove compartment and, during the car locking process, the Customer will be asked to send a photo of  the key and, if applicable, the parking ticket, via ROIG’s locking process. 

The vehicle will be locked via the link provided through the messaging service selected by ROIG (SMS or  any other similar service that may replace them in the future). 

ROIG’s fuel policy is full-full. Upon pick-up of the vehicle, ROIG will charge a deposit equivalent to the cost of a full tank, which will be returned at the end of the rental period once the vehicle’s fuel level has been  checked. This amount may vary depending on the model selected (this amount may be found in Appendix II  of these General Terms and Conditions of Car Hire). 

  • For plug-in hybrid models, in addition to the amount of the fuel tank, an amount of 100€ will be  blocked for providing the EV charging cable, which will be reimbursed upon its return. 
  • In the case of vehicles with Adblue, they will be provided with a sufficient minimum and it will be the  Customer’s responsibility to refuel with Adblue in case of need. 
  • If at the time of pick-up of the vehicle, the fuel tank is not full, the Customer should notify it to ROIG’s office staff within the first hour after the beginning of the Rental Contract. 
  • In the event that a full-empty fuel policy has been contracted, a full tank of fuel will be charged at the  beginning of the rental. The vehicle will be handed over with a full tank of fuel and can be returned as desired, without any partial or total reimbursement of the fuel. 
10.1 Electric vehicles

In the case of vehicles with electric motors and plug-in hybrid vehicles, ROIG will provide the vehicle partially or fully charged together with the corresponding EV charging cable. It will be an indispensable condition for  the Customer to return the vehicle together with the cable that was supplied to him and, in the case of  vehicles with a 100% electric motor, to return it with a minimum range of 25km. If this condition is not met,  ROIG will charge the amount corresponding to the cost of transporting the vehicle to the nearest facilities  and/or the cost of acquiring a new EV cable (see Appendix III for the cost of replacing different cables). 

For electric and plug-in hybrid models, an amount of 100€ will be blocked for providing the EV charging  cable, which will be reimbursed upon its return at the end of the Rental Contract. 

In the event of an accident, the Customer undertakes to: 

  1. a) Obtain and, send to ROIG within forty-eight hours after the accident, full details of the other party and possible witnesses by filling in an accident report by means of a ‘Amicable Accident Report’ – in  Spanish ´DAA´- detailing the car registration number, the name and address of the other party, the  circumstances of the collision, a sketch of the accident, the name of the insurer and, if possible, the  insurance policy number, all signed by the two drivers involved in the accident, or, if this is not  available, the ‘Damage Report’, which will be provided by ROIG. 
  2. b) Immediately notify the authorities if the culpability of the other party needs to be investigated or if  there are any injured persons. 
  3. c) Not to abandon the rented vehicle without taking adequate measures to protect it. 

In the event of vandalism, fire, theft or disappearance of the vehicle, the Customer undertakes to  immediately inform ROIG of the incident and to file the corresponding report to the relevant authorities, a  copy of which must be sent to ROIG as soon as possible. 

It is the Customer’s obligation to use the vehicle with due diligence, in accordance with its characteristics,  respecting the current motor vehicle traffic regulations and avoiding, in any case, any situation that could  cause damage to the vehicle or to third parties.

Likewise, it is the Client’s obligation not to allow the vehicle to be driven by any person other than those  authorised in accordance with the Rental Contract, the Client being directly responsible for any damage  caused to the vehicle or to third parties in such a case. 

Any case of non-compliance with the conditions established in these paragraphs will be understood as  unauthorised use. 

The Client will be fully liable, regardless of the coverage contracted, for damages caused to interior and  exterior parts of the vehicle due to unauthorised or negligent use of the vehicle, in which case the Client is  obliged to pay all the costs incurred, in accordance with the conditions established in section 4 of these  General Terms and Conditions of Car Hire. 

Unauthorised or negligent use includes, but is not limited to, the following examples: a) Pushing or towing any other vehicle. 

  1. b) Driving in areas that are not suitable for public transport, such as beaches, racing circuits, forest  tracks, country roads, etc. 
  2. c) Driving on roads that are not asphalted, or are asphalted but with serious deficiencies, which could  lead to damage to the underside of the vehicle. 
  3. d) Driving the vehicle on restricted areas, including in particular airport runways and other roads  associated with aeronautical and/or military use. 
  4. e) Ignoring the warning lights or warning signs on the dashboard of the rented vehicle, which the Client  declares to be aware of by signing the Rental Contract. 
  5. f) Transportation of goods or animals and especially of dangerous, inflammable and/or harmful to the  vehicle and its occupants substances. 
  6. g) Transport of persons or goods that directly or indirectly implies a payment to the Client. h) The subleasing of the vehicle. 
  7. i) The use of the vehicle in any activity against the law. 
  8. j) The carriage of a number of persons or amount of luggage exceeding those authorised for the  vehicle. 
  9. k) Any type of manipulation or intervention in the odometer, and ROIG must be immediately informed of any malfunctioning of it. 
  10. l) Transporting luggage or any other item on the roof of the vehicle, even when using a suitable device  for this purpose. 
  11. m) Leaving objects visible in the vehicle likely to be stolen with the consequent damage to the vehicle. n) Soiling the interior of the vehicle beyond what is considered as reasonable and careful use. o) Driving the vehicle when fatigued, ill or under the influence of alcohol, medication or drugs. p) Reckless driving. 
  12. q) Use of the vehicle for learning to drive in any circumstances and/or for the teaching of any special  driving skills. 
  13. r) Driving against traffic regulations.
  14. s) Driving the rented vehicle by a person not authorised in the Rental Contract either as a Client/s  and/or additional driver/s. 
  15. t) Driving the vehicle outside the island of Mallorca, unless there is a signed and explicit authorisation  from the Company’s management in both cases and the corresponding extraordinary ADDITIONAL  COVERAGE is contracted and paid for. 
  16. u) Use of the vehicle after the end of the rental period. 
  17. v) For all relevant purposes, we inform you that, for security reasons, part of our fleet is equipped with  GPS locator devices. The Company will access the location data only in the event of (i) an alert due  to disconnection or inhibition of the system, and/or (ii) non-return of the vehicle. The Client is aware  of and accepts this circumsmtance, refraining in any case from interrupting or preventing its correct  

functioning. 

An unauthorised use by the Customer will entitle ROIG to terminate the Rental Contract early due to the  Customer’s culpable breach of the Rental Contract, requesting, if applicable, the corresponding  compensation for damages. 

All Customers and/or authorised additional drivers will be jointly and severally liable for all the Customer’s  obligations arising from the Rental Contract and the laws applicable thereto. 

ROIG is not held responsible for objects stolen, forgotten or lost inside the vehicle.

In the event that the vehicle is used to transport children under three years of age or older children who do  not exceed 150 centimetres in height, the Customer must inform ROIG so that, upon payment of the  corresponding rental fee and without anchoring it to the vehicle, the corresponding homologated mandatory  restraint device, in accordance with the weight and size of the child or person who shall be using it, may be  provided. The installation of such device will always be the Customer´s responsibility.

16.2 Purposes of personal data processing

In compliance with the regulations established in the European General Data Protection Regulation  2016/679, as well as in any applicable national law, we inform you that AUTOS D’OR RENT A CAR, S.L.U.  processes the personal data you provide us with for the following purposes: 

  1. To manage the contractual relationship concerning the vehicle rental; 
  2. To manage and invoice the vehicle rental; 

III. To manage possible incidents, including damages occurred during the vehicle rental period;

  1. To manage administrative procedures and notifications that may arise from the contractual  relationship; 
  2. To keep the Customer periodically informed, by e-mail or any other equivalent means, of all  the offers, products, services and promotions, whether our own or those of third parties,  which may be of interest to the Customer; 
  3. To develop promotional actions by companies from the transport and tourism sectors that  collaborate in activities carried out by ROIG; 

VII. In the event that the Customer wishes to become a member of ROIG´s VIP Customers  Group, to manage the process of registering for this loyalty programme. Any Customer who  has made three rentals in the last two years may join this programme and benefit from  exclusive offers. 

VIII. To elaborate a commercial profile based on the progress of the commercial activity in  relation to the completed reservations. To this end, we inform you that no automated  decisions will be taken on the basis of this profile. 

16.3 Personal data of third parties

In the event of providing personal data of third parties, the Customer declares that he has the consent of  those affected to do so, having previously informed them of the content of this privacy policy. 

16.4 Data retention period

We inform you that your data will be kept for as long as they are necessary for the provision of the services  or contractual relationship, and in any case as long as you do not request their deletion, as well as for the  time necessary to comply with the legal obligations corresponding in each case according to each type of  data. 

16.5 Legitimation

The legitimate basis for your personal data processing lies in: 

  • The legal basis which constitutes the processing of your personal data for the purposes (I), (II), (III)  and (IV) indicated in section 16.2 above is based on the execution of a Rental Contract with ROIG in  relation to the services you have requested from us. 

Likewise, the legitimate basis for processing your personal data for the purposes indicated in sections (V),  (VI), (VII) and (VIII) above is based on the explicit consent you give for each purpose at the time of collection  of your personal data that you provide to us through booking the vehicle. 

16.6 Recipients

Your personal data will be transferred to third parties in order to process the payment of the bookings made  (i.e. banks and/or financial institutions that own the means of payment used, payment gateways). 

In addition, ROIG may pass on your data to insurance companies for the management and processing of  damages occurred during the rental period. 

We inform you that your data mentioned herein may be transferred for internal administrative purposes to the companies of the group to which ROIG belongs. 

In addition, your data may also be transferred to public agencies and authorities (administrative or judiciary)  in those cases in which a legal regulation states so.

16.7 Rights

You have the right to access your personal data, as well as to request the rectification of inaccurate data or,  if applicable, to request its deletion when, among other reasons, the data is no longer necessary for the  purposes for which it was collected. 

In certain circumstances, you may request the limitation of your data processing, in which case we will only  keep them for exercising or defending claims. 

In certain circumstances and for reasons related to your particular situation, you may oppose to the  processing of your data. ROIG will stop processing the data, except for compelling legitimate reasons, or for  exercising or defending possible claims. 

Likewise, you may exercise your right to data portability, as well as withdraw the consents provided at any  time, without this affecting the legality of the data processing based on the consent prior to its withdrawal. 

If you wish to exercise any of your rights, you may contact us by sending a written notification addressed to  ROIG’s Customer Service Department at Avinguda Benvinguts 64, Cala d’Or (Santanyí), 07660 Spain. 

The request to exercise any of your rights must be accompanied by a copy of an official document that  identifies you (ID card or supporting document). 

Finally, we inform you that you can address any claim arising from the processing of your personal data to  the Spanish Data Protection Agency and other competent public bodies.

18.1 Fleet ownership 

The Company AUTOS D’OR RENT A CAR, S.L.U. is the owner of all the vehicles rented through ROIG Rent a Car. 

18.2 Geolocation of the fleet 

The rented vehicle is equipped with a geolocation system (GPS), which will be activated from the moment  the Customer collects the vehicle and which will be in service throughout the duration of the Rental Contract. 

The purpose of this geolocation system is to locate our vehicles in the event of theft, in the event of non return of the vehicle to ROIG’s offices or to locate the vehicle in the event of an accident or breakdown.

Any manipulation of the geolocation system of the rented vehicle will be cause for the termination of the  Rental Contract and may give rise to a claim against the Customer for any damage that may have been  caused to the aforementioned system.  

In order to proceed with the notifications applicable to this Rental Contract, the parties expressly declare that  their addresses for notification, including e-mail, are those stated in the Rental Contract.
